Fair Use & Acceptable Use Policy

What counts as acceptable use of WhatsMark — opt-in and consent requirements for every contact you upload, prohibited messaging, spam and abuse rules, and Meta’s WhatsApp Business Messaging Policy.

This Fair Use & Acceptable Use Policy ("AUP") governs how you may use the WhatsMark Service and the WhatsApp Business Platform through it. It supplements our Terms & Conditions. Breach of this AUP is a material breach of the Terms and may result in immediate suspension or termination without refund.

4.1 Opt-in & consent (non-negotiable)

  • You must obtain explicit, verifiable opt-in consent from every recipient before sending them any
    message, in line with Meta's WhatsApp Business Messaging Policy.

  • You must keep records of how and when consent was obtained.

  • You must honour opt-out / STOP requests immediately and maintain suppression lists.

  • You must not upload purchased, scraped, rented, or otherwise non-consented contact lists.

4.2 Prohibited content & businesses

You may not use the Service to send, store, or promote content related to:

  • Illegal goods/services, drugs, weapons, or controlled substances;

  • Adult/sexual content, gambling/betting where unlicensed, or pyramid/Ponzi/MLM schemes;

  • Hate speech, harassment, violence, or discrimination;

  • Fraud, phishing, deceptive or misleading claims, or impersonation;

  • Counterfeit goods, stolen data, or intellectual-property infringement;

  • Malware, or anything that violates Meta's WhatsApp Commerce Policy or Business Policy.

4.3 Anti-spam & messaging conduct

  • No unsolicited bulk messaging ("spam").

  • No sending excessive messages designed to evade Meta's rate limits or quality systems.

  • No content designed to provoke blocks/reports or to harass recipients.

  • Maintain a healthy quality rating; repeated low quality, high block/report rates, or template
    rejections may trigger review or suspension.

4.4 Platform integrity & technical limits

You may not:

  • Use bots, scrapers, or automated means to access the Service except via our provided APIs;

  • Attempt to bypass rate limits, quotas, plan limits, or security controls;

  • Reverse-engineer, overload, or interfere with the stability or security of the Service;

  • Resell or sublicense the Service except under an authorised reseller agreement.

Plan-based limits (contacts, messages, campaigns, AI tokens, channels, etc.) are enforced per your
subscription. Sustained usage that materially exceeds fair, intended use — even within an "unlimited"
plan — may be throttled or require a plan upgrade.

4.5 Consequences of violation

Depending on severity, we may:

  1. Issue a warning and request remediation;

  2. Throttle or temporarily suspend affected features or your account;

  3. Permanently terminate your account without refund;

  4. Report unlawful activity to Meta and/or law-enforcement authorities.

We may act immediately and without prior notice where there is risk of harm, legal exposure, or
threat to our standing with Meta. Actions taken by Meta against your number/WABA are independent of
us and are not grounds for a refund.

4.6 Reporting abuse
